Can I decline to accept the settlement?
Yes, but we do not recommend that you do. We do not believe that it is in your best interest to continue the litigation. We don't believe that the Captive Insurance Company will make a better offer in the future. Additionally, if you proceed in the litigation your cases will be subject to the defendants’ now-pending motions for summary judgment on a variety of complex legal issues. If the Judge rules in the defendants’ favor on any of those motions, your case may be dismissed and you will not receive any compensation. Proceeding with the litigation will be risky, time consuming and expensive. The defendants have many defenses to your claims including immunity, causation and whether or not they actually owed you any duty. These defenses will be tested on your case if you decide to proceed which may result in the dismissal of your case. If your case is dismissed you will not receive any compensation.
