DON’T MISS 11/8 OPT-IN DEADLINE WAITING FOR UPDATED RECORDS OR CLAIM FORMS

The November 8, 2010 deadline to opt-in to the settlement with the City of New York and its Contractors is fast approaching but some of you still have not returned your executed settlement forms to us for processing.  Two forms must be signed and returned before the November 8, 2010 deadline: (1) your Release and (2) your Second Injury Letter. 

The Release is at page 9 of the 12-page document entitled “Exhibit P – Release and Covenant Not To Sue.”  This document must be signed by both the primary plaintiff and the derivative plaintiff (spouse) before a notary public and must be notarized.  The Second Injury Letter is a two-page document that must also be signed before a notary public and notarized.  If you return these two documents with the proper signature and notarization before the November 8th deadline, you will have timely opted-in to the settlement. 

Do not hold off on signing your Release and Second Injury Letter because you are waiting for additional updates from your medical records or recalculation of your settlement range.  If you have been told that an update or recalculation of your Injury Point Verification chart and/or Claim Form is being prepared for you, please do not wait for the updated forms to sign your Release and Second Injury Letter – you can sign now and submit updated forms later.  As long as you opt-in to the settlement by the November 8, 2010 deadline, we will have an additional 45 days after the deadline to submit your claim forms to the Allocation Neutral for his review.  But we cannot submit your claims forms after November 8th unless you submit a signed Release and Second Injury Letter before the November 8 cut-off. 

Remember, we must achieve a 95% opt-in threshold for this Settlement to take effect.  Remember also that for every percentage point of opt-ins over 95%, additional monies come into the overall settlement pool, which can increase the total value of the settlement from $652 million to as high as $712.5 million. 

Don’t find yourself after November 8th wondering why you passed up your best chance of a meaningful recovery for your World Trade Center injuries.   Don’t wait for updated medical records or settlement recalculations.  Sign your Release and your Second Injury Letter now before the November 8th deadline passes.
