BY COURT ORDER WE CANNOT DISCUSS THE OPT-IN PERCENTAGE. PLEASE DO NOT CALL OUR OFFICES ASKING ABOUT IT.

On Monday, November 8, 2010, Judge Hellerstein issued an Order directing that none of the parties or their lawyers may discuss publicly the status of claims in relation to the Opt-In Threshold under the World Trade Center Litigation Settlement Process Agreement, As Amended ("Amended SPA").  The Court also extended the deadline for opting in to the Settlement from November 8, 2010 at 11:59 pm until next Tuesday, November 16, 2010 at 11:59 pm.

Many of our clients have been repeatedly calling our offices seeking information about the percentage of clients who have opted in to the settlement, and demanding information about when their settlement money will be paid. Unfortunately, a small percentage of these callers have been verbally abusive, and some have even threatened our staff and attorneys. 

We beg your patience and cooperation.  We represent more than 9000 clients in the World Trade Center litigations and are trying to do our best for each one.  Right now, it is imperative that we concentrate our time until the November 16, 2010 deadline on reaching all of the clients who have still failed to opt in to the settlement or respond to our calls and letters. 

IT IS IN YOUR BEST INTEREST to allow us to do so, because for every additional person who opts in to the settlement there is the potential for a greater overall monetary return in the end – and if 100% of the plaintiffs opt in, the value of the Settlement with the City and its Contractors will go from $625 million to $712.5 million! 

We are also busy taking calls from clients who still need our help understanding their settlement offers and settlement papers, and from clients who need our assistance in properly executing all of the documents. 

Nothing we can tell you on the phone will make this process go faster, and repeated phone calls -- particularly abusive calls and threats – are distracting and counter-productive.  Please be patient and allow us to do our best job to represent you and your fellow World Trade Center plaintiffs effectively while we bring this Settlement to the most successful close that we can.

You are all important to us and we are doing our level best to serve your needs and interests in this litigation.  Please keep that in mind before you start dialing your phone.
